0. Right to Set Up Equipment for Professional Quality

The service provider has the right to set up and position all necessary equipment—including but not limited to light stands, tripods, sound recorders, field microphones, and connections to the DJ mixer—in a manner that ensures the highest professional quality. If the client objects to the placement or use of any required equipment, or insists on excluding specific equipment, they fully acknowledge and accept that the final video, photo, or sound quality will not meet the advertised professional standards displayed in the service provider’s portfolio. The client knowingly chooses to compromise quality over their preference to restrict equipment usage, and the service provider will not be held responsible for any dissatisfaction resulting from these limitations.

1. Single-Set Feedback Submission

The client must review all delivered videos and photos and provide a complete list of feedback within one week (7 days). The feedback should include all requested changes in a single, comprehensive set of instructions. Only reasonable changes within the agreed-upon scope will be accommodated. Additional rounds of feedback or requests beyond the initial set will not be accepted. Delayed feedback may affect project timelines, and the service provider will not be obligated to accommodate indefinite delays.

2. Video Revision Policy

The service provider will accommodate standard revision requests within the scope of simpler adjustments, including cutting or trimming video segments, adding or removing music, adjusting volume, modifying brightness or color, altering video length, and incorporating provided images or photos. Requests for complex visual effects, such as those seen in Hollywood movies, TV shows, or high-budget commercials, are not included in the scope of revisions. Additionally, specific effects or transitions that require advanced editing techniques or tools will not be provided. The focus remains on delivering high-quality standard edits to enhance the video without incorporating advanced or highly technical effects.

3. Photo Revision Policy

The service provider will accommodate revision requests limited to standard adjustments, including color correction, brightness or contrast modifications, noise removal, and other enhancements that refine the overall artistic quality of the photos. However, requests for significant image manipulations—such as altering physical features, changing body shapes, or modifying the content of the image to add or remove elements—are not included in the scope of revisions. Such advanced manipulations, which require extensive effort or specialized tools, are outside the standard editing process. The service provider's edits focus on maintaining artistic integrity and delivering high-quality, professionally enhanced photos, without altering the original context or nature of the images.

4. File Delivery Options

By default, the client will receive a secure cloud download link for their files at no additional cost, which will expire 21 days after notification. Alternatively, the client may request a USB flash drive, which will be mailed via Canada Post for a total cost of $75. The USB flash drive’s make and model will be chosen at our discretion. If the client requests a physical delivery of the USB flash drive to their house or another specified location, the total cost for this delivery service, including the USB drive, will be $125.

5. Audio Quality and Venue Cooperation

The client acknowledges that the sound quality in the final video is dependent on the venue’s sound system and the cooperation of the DJ or sound engineer. To achieve optimal audio, it is essential to connect our dedicated sound recorder to the venue’s mixer output. If the DJ or sound engineer does not permit this connection, we will record using an ambient field microphone, which may capture background noise and result in less clear audio. The client agrees to either ensure the DJ or sound engineer’s cooperation or accept that the audio quality may not meet professional standards without a direct connection.

6. Trust in Professional Judgment for Photo Editing

The client agrees to trust the service provider’s professional judgment in the editing of photos, including the use of industry-standard techniques and creative discretion. The final edited photos will be delivered as a reflection of the service provider's artistic vision and high-quality standards. Any specific preferences regarding the style or look of the photos must be communicated prior to the event to ensure alignment with the client’s expectations.

7. Trust in Professional Judgment for Video Editing and Color Grading

The client agrees to trust the service provider’s professional judgment in the editing and color grading of the video, using industry-standard techniques and creative discretion. The final video will be delivered as a reflection of the service provider's artistic vision and commitment to high-quality production. Any specific preferences regarding editing style, color grading, or other elements must be communicated prior to the event to ensure alignment with the client’s expectations.

8. Music Choice for Video

The client agrees to trust the service provider’s professional selection of music for the video. If the client has specific music preferences or concerns about the selection, the client must provide their chosen music before the event. Once the editing process is complete, the service provider will not be obligated to re-edit the video based on dissatisfaction with the music choice if no preferences were provided in advance.

9. Exclusivity of Services

To ensure the best quality and consistency in our work, we must be the exclusive photographer and videographer for the event. The client agrees to ensure that no other party (whether professional or amateur) will obstruct our view or interfere with our creative process during the event. This allows us to capture all key moments smoothly and maintain the integrity of our artistic vision. All posing, styling, and creative direction are the intellectual property of SpicyVision Productions.

10. Exclusivity of Videography Service

To ensure the best quality and consistency in our work, we must be the exclusive videographer for the event. The client agrees to ensure that no other party (whether professional or amateur) will obstruct our view or interfere with our creative process during the event. This allows us to capture all key moments smoothly and maintain the integrity of our artistic vision. All posing, styling, and creative direction are the intellectual property of SpicyVision Productions.

11. Exclusivity of Photography Service

To ensure the best quality and consistency in our work, we must be the exclusive photographer for the event. The client agrees to ensure that no other party (whether professional or amateur) will obstruct our view or interfere with our creative process during the event. This allows us to capture all key moments smoothly and maintain the integrity of our artistic vision. All posing, styling, and creative direction are the intellectual property of SpicyVision Productions.

12. Parking Accessibility

The client agrees to provide suitable and convenient parking at or near the venue entrance to ensure the timely offloading of our equipment. This parking space should allow us to quickly and safely transport our gear into the venue. If appropriate parking is not available and we are required to park further away, this may result in delays in starting the work and may prevent us from using all necessary equipment, which could affect the quality of our services. Additionally, transporting equipment over a long distance poses a security risk to our gear. In the event that suitable parking is not provided and such risks arise, we reserve the right to refuse service, and no refunds will be issued for the cancellation of services due to parking-related issues.

13. Capture of Key Moments

While we strive to capture all important moments during the event, we cannot guarantee the capture of every specific moment due to the nature of live events. The client understands that no specific moment is guaranteed to be captured, and we are not responsible for any missed moments.

14. File Retention and Responsibility

The client understands and agrees that the service provider is not obligated to retain copies of photos or videos beyond three (3) weeks (21 days) after final delivery. The client must confirm that all files have been downloaded and backed up within this three-week period. If no confirmation is received by the end of this timeframe, it will be assumed that the files have been successfully downloaded and backed up. After this period, all original files will be permanently deleted from the service provider’s system, and further revisions or file recovery will no longer be possible.

15. Intellectual Property and Use of Photos/Videos

All final photo products will be delivered to the Client with non-exclusive rights for personal use. The Service Provider retains the copyright to all images and videos, with the right to use them for promotional purposes, including but not limited to portfolio display, websites, social media, and other professional platforms.

16. Limitation of Liability

We use professional-grade equipment and take all necessary precautions to ensure your photos/videos are safely captured and stored. However, in the rare case of equipment malfunction, data loss (e.g., memory card failure), or any unforeseen event, our liability shall not exceed the total amount paid by the client for services.

17. Equipment Safety and Usage

The client agrees to provide a safe environment for our equipment during the event. In the event of any damages to our equipment due to the actions or negligence of the client or their guests, the client will be held liable for the cost of repairs or replacement. This includes, but is not limited to, damages caused by liquid spills, unauthorized handling, or accidents involving our equipment.

18. Set-Up and Dismantling

We require adequate time and space for the set-up and dismantling of our equipment. The client agrees to provide access to the venue at least two hours before the start of the event for the initial setup and one hour after the event for the dismantling process. If venue restrictions or delays impact our ability to set up or dismantle within these timelines, additional charges may apply, and service quality may be affected.

19. Laser Light Restrictions

Laser lights can permanently damage camera sensors, which can be as costly as replacing an entire camera. To protect our equipment, the client agrees to ensure that no laser lights or similar equipment are used during the event. If the DJ or any other vendor uses laser effects, the client will request that they turn off the laser effects so that we can continue working. If the DJ or vendor does not comply with this request, we will have no choice but to stop working, without any refund for not continuing the service.

20. Governing Law

This agreement is governed by and shall be construed in accordance with the laws of Ontario. Any disputes arising under this agreement shall be subject to the jurisdiction of the courts located in Ontario.

21. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or understandings, whether written or oral, relating to the subject matter of this Agreement.
